1. Agreement to Terms
By accessing or using Enigma's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services
Enigma provides web design, development, maintenance, and security services. The specific scope of services will be outlined in individual project agreements or service contracts.
3. Payment Terms
For website packages, payment is typically structured as: 50% deposit before project start, and 50% upon completion before launch. Monthly services (Care+, Security+) are billed monthly in advance. All prices are in EUR and exclude VAT where applicable.
4. Project Timeline
Project timelines are estimates provided in good faith. Delays may occur due to: client feedback delays, scope changes, or technical requirements. We will communicate any significant timeline changes promptly.
5. Client Responsibilities
Clients are responsible for: providing necessary content, images, and materials, timely feedback and approvals, ensuring they have rights to all provided materials, and maintaining backup copies of their content.
6. Intellectual Property
Upon full payment, clients receive full ownership of custom designs and code created specifically for their project. Enigma retains the right to use general techniques, skills, and non-confidential elements for other projects.
7. Maintenance Services
Care+ and Security+ services are provided on a monthly subscription basis. Services can be cancelled with 30 days written notice. Refunds are not provided for partial months.
8. Limitation of Liability
Enigma's liability is limited to the amount paid for services. We are not liable for: indirect or consequential damages, loss of profits or data, third-party claims, or issues arising from client-provided content.
9. Termination
Either party may terminate services with written notice. Upon termination, client will receive all completed work and materials. Outstanding payments remain due.
10. Governing Law
These terms are governed by the laws of the Republic of Estonia. Any disputes shall be resolved in Estonian courts.
